Chaos for social welfare reform: dispute between the federal government and the federal states!

On September 25, 2025, a opening meeting for the reform of social assistance took place in the Ministry of Social Affairs. Representatives of the federal and state governments discussed constitutional issues that led to discrepancies. The aim of this reform is a nationwide standardization of social assistance until the beginning of 2027. Among other things, the Minister of Social Affairs Korinna Schumann (SPÖ), social spokesman for the ÖVP and NEOS as well as representatives of the federal states, who spoke to the results controversy.

The discussions were interpreted differently from different sides. The ÖVP representative Christian Dörfel reported that legal concerns about a waiting phase for Austrians were cleared. Meanwhile, the Vienna Social Councilor Peter Hacker described the meeting as "more than a good start". For Vorarlberg's social councilor Martina Rüscher (ÖVP), however, many questions about the implementation of the reform remained open.

Discreps with reform plans

With regard to the reform plans, the regulations for immigrants were primarily cited. According to the proposals, stricter conditions should apply: a waiting period with limited services is planned. In addition, social benefits in participation in integration measures are to be linked. These measures include the acquisition of the German language, employment agency and mediation. Critical voices were particularly clear about the unclear about the equal treatment of asylum seekers and Austrians, since an expert opinion from the constitutional service promised the legal possibility of the same treatment.

A central topic of the reform is integration, which, according to the government, is to be clearly regulated from the first day. The reform is based on three pillars: a uniform regulation of social assistance, mandatory integration measures and its own support model for children. The latter is intended to remove children from social assistance logic and increase their chances of a better life.

Diversity of opinions and challenges

However, the reform plans came across different reactions. FPÖ State Councilor Hannes Amesbauer expressed significant criticism and described the start as "bumpy". Tirol's social councilor Eva Pawlata emphasized the challenges through the different conditions in the federal states, especially since Lower Austria has the strictest social welfare regulations that are to be retained.

The Greens criticized the inner coalition confusion and demanded serious reform work with social organizations. The need to take children out of social assistance was emphasized by the SPÖ, while the ÖVP focuses on more restrictive regulations. There is also the suggestion to check the graduation of the social welfare contributions according to the number of children.

Overall, it remains to be seen how the reform will be implemented in the coming months. The specific schedule for the implementation of the new social assistance is still pending, with an in-force setting for July 1, 2027. The next steps are crucial to ensure the intended increased transparency and efficiency as well as promoting integration in society. In the meantime, the discussion about the legal framework will continue to gain in importance, since the report for the legal admissibility of the government plans still leaves many open questions.
