The incident occurred on November 2nd last year in the parking lot of an outlet center, where the damage is estimated at over 2,000 euros. The public prosecutor's office targeted the defendant after a witness noted the license plate number of the fleeing vehicle and alerted the police.

The defendant, who vehemently denied the accusation, appealed against a penalty order, which led to the court hearing. Her lawyer, Sebastian Hamm, argued that no damage could be seen in the photos of the allegedly damaged vehicle. The tension rose when a 20-year-old witness who had witnessed the incident came into play. She reported that the person who caused the accident hit a dark BMW while reversing out of a parking space. “You heard that too,” explained the witness, who also saw the occupants of the BMW, including two women and a child, assessing the damage before getting back into their car and driving away.

A surprising ending

The defense noted that the witness could not positively identify the driver, which complicated the situation. The lawyer then requested that the proceedings be discontinued. And in fact, the judge decided to temporarily stop the proceedings on the condition that the defendant transfers 900 euros to the Child Protection Association. The 48-year-old not only escaped with a fine, but also without a driving ban - an unexpected result in a case that raised many questions!
