Authority fails: Liana murderers not deported - the background!

In an alarming case of failed deportation, 31-year-old Iraqi Muhammad A. was suspected of killing 16-year-old Liana K. on August 11, 2025. A., who was arrested on the basis of an arrest warrant, was a known asylum seeker whose deportation to Lithuania had already been requested by Germany in October 2022. However, this project failed due to a lack of legal basis.

The immigration authority was planning to take A. into deportation. But on July 20, 2025, he was released due to a formally inadmissible application for prison. The authority had referred to the wrong file side and could not provide a sufficient reason for a "considerable risk of escape". The Minister of the Interior, Daniela Behrens (SPD), announced that it would work up the case and clarify the background. This situation raises questions about the efficiency and accuracy of the German immigration authorities.

Background for deportation

Deportations in Germany are regulated by law and serve the compulsory measure to terminate the stay of people without right of residence. The decision to deport the deportation is usually made by the immigration office with a written notification, which also contains a deadline for a voluntary departure. If this period is not complied with, the people concerned can make a legal objection to the decision. If an objection failed, a compulsion to deport is also possible, which was also relevant for Muhammad A., but initially succeeded in using the legal process for its advantage. The Göttingen Administrative Court had initially granted his complaint.

The deportation is not just a uniform process. There are different forms, including the controlled departure and the accompanied deportation, which each depend on the willingness to cooperate. Different to this must be a ban on deportation for humanitarian or international reasons as well as the possibility of toleration, which, however, does not grant a lawful stay.

Acute situation and police operations

As he lived in Germany, A. repeatedly appeared in the police report. On August 11, 2025, he employed the police three times without being arrested. Finally, he was recognized as a rioting man in a border passage warehouse and temporarily brought to a psychiatric facility. On the same day, he led the officials to the motionless body of Liana K. and claimed that she was hit by a freight train. This tragic event is now being treated in the interior committee of the Lower Saxony state parliament, with Behrens only sending one department head for the hearing.

In a larger context, the numbers of deportations are in Germany. In 2024, a total of 20,084 people were deported, which shows that the problem of deportation measures and their implementation is still up to date. With regard to the countries of origin, in 2023 people from Georgia, Turkey, Afghanistan and Northern Macedonia were affected, and Iraqi nationals were among them.

The tragedy around Liana K. is an impressive example of the complex challenges in the field of migration and international law in Germany. The processing of the conditions that led to this situation will play a central role in the upcoming political discussions.
