Raids against the right -wing scene: suspect after attack!
In an extensive campaign, investigative authorities in three federal states carried out searches due to an attack on members of the SPD and the police. These missions took place in Lower Saxony, Saxony-Anhalt and Saxons, such as Jaumann reported . The searches were carried out in several cities, including Wolfsburg, Aschersleben, Halle an der Saale, Schkopau, Leuna and Rötha.
Various objects were confiscated as part of these searches, including cell phones, digital storage media and alleged crime clothing. Masking utensils, dangerous objects such as key tools and knives as well as right -wing extremist propaganda material also found their way into the investigative files. Overall, the suspicion of eight people is directed. Among the already known suspects are four young men aged 16, 18, 19 and 19, three of whom are already in custody. New suspects are three other people aged 15, 19 and 21 years and a 16-year-old who are also suspected of being involved in the attack.legal foundations of the searches
The searches carried out are regulated in accordance with the Code of Criminal Procedure (StPO). According to Juracademy , searches are instruments for finding evidence and are subject to certain legal provisions. Section 102 of the Code of Criminal Procedure regulates the search for the suspect, while § 103 StPO concerns the search for third parties. The prerequisites for a permissible search are, among other things, actual indications for a crime and the possibility of finding evidence.
In addition, the arrangement of the search and the associated confiscations are treated in §§ 94 ff. StPO, whereby it must be determined that there is a risk in delay in order to be able to deviate from the general requirements. When ensuring and confiscation of objects, strict requirements apply to protect the rights of those affected.
