Handsman Council shocked: acquittal for Waldhäusl and the explosive piquant!
At the center of the current judicial debate is the indictment against the free politician Waldhäusl, which was not approved by the office council. According to the Kleine Zeitung have been charged with Waldhäusl and a former state employee of the abuse of office. They are accused of having brought unaccompanied minor refugees to an asylum accommodation, which is limited with barbed wire, which is considered unsuitable. However, the council of instructions, an advisory body, was of the opinion that the indictment should not be noted due to an "incorrect application of a law".
instructions and Ministry of Justice in conflict
The Economic and Corruption Prosecutor's Office (WKSTA) originally planned to stop the procedure against Waldhäusl, but decided after examination by the Vienna Chief Prosecutor's Office. Although the instructions for instructions finally found that the indictment was not justified, essential questions of abuse of office remained open. The Ministry of Justice admitted that the new indictment did not have to submit it to the board of directors, but pointed out that this could not be interpreted as an approval of the indictment. A reference refers to a "misunderstanding", which was affected by the department of the ministry, as bmj.gv.at
In her report, Minister of Justice Alma Zadic also made it clear that the teaching of instructions by the board of directives plays an important role in criminal investigations. The minister is obliged to report parliament annually about the instructions given, in particular about cases in which the advice of the council was not paid to the statements. The indictment against Waldhäusl is now the focus of the legal discussion about the limits of violence in dealing with refugees, whereby the exact extent of the allegations and the legal framework must be analyzed.
