Sporrer quits reforms: Independent public prosecutor in sight!

Österreich - Anna Sporrer has been Austria's new Minister of Justice (SPÖ) under Chancellor Christian Stocker (ÖVP) for a month. In an interview in ZIB 2, she commented on the challenges that the judiciary faces. Sporrer emphasized that the current state of the judiciary is influenced by a variety of social problems, including the economic crisis, Corona pandemic and the Ukraine War. These factors affect the dishes and increase the pressure on the judiciary.

In order to meet these challenges, talks are already underway to introduce a federal prosecutor. Sporrer announced that the reform should be implemented as soon as possible. The core target of this initiative is to prevent influence through power, money or political interests and the impression that the Minister of Justice could influence the procedure. The collegial management of the public prosecutor is crucial, as stated in the coalition agreement. A parliamentary control committee is only intended for procedures that have already been completed to ensure the independence of the public prosecutor.

Reform of the public prosecutor's office

A central element of the reform concerns the public prosecutor's peak instructions. Sporrer plans to convert them into an independent collegial organ in order to prevent political influence on investigative procedures. In the past, there have been repeated attempts at political influence on public prosecutor's investigations, as an investigation commission has determined. These reports have severely affected trust in the integrity of the public prosecutor. An example of such influence occurred in autumn 2023 when an application by the Vienna public prosecutor's office was rejected for custody and the Justice Minister ordered to refrain from a complaint that was considered problematic.

Sporrer emphasized that

given an acute lack of personnel in the judiciary, in which a total of 200 judge positions are missing, that savings could be necessary. Nevertheless, according to her own statements, she is committed to creating additional judge posts. In addition, measures to accelerate procedures are to be taken, which is particularly important for complex processes, such as the former finance minister Karl-Heinz Grasser. The passage of procedures is to be made more efficient in the future, including a new “buddy system” that supports younger prosecutors.

social pressure and procedural duration

The judiciary has to struggle with long procedural times in the current Situation, which in some cases take decades. Critics advocate that additional revenues from court fees should be used for process acceleration. In this context, Sporrer emphasized that the average procedure is already very short, but the pressure on the dishes remains high. It is aware that society is under enormous pressure in times of inflation and international conflicts, which also affects the way the dishes work.

Overall, Sporrer strives to reform the judiciary comprehensively and at the same time ensure that the influence of politics and business no longer endangers the integrity of the public prosecutor. It remains to be seen how the implementation of these ambitious plans progresses and what effects you will have on the Austrian legal system.
