Aldi Süd has to take Dubai chocolate out of sale for misleading
Köln, Deutschland - The discounter Aldi Süd must remove its popular Dubai chocolate from the shelves. The Cologne Regional Court decided that the product, which is marketed as "Alyan Dubai Handmade Chocolate", actually had to have a geographical relationship with Dubai. Otherwise there is a great risk that customers will be misled, reported krone.at . This judgment was not unexpected: the chocolate in Austria had already been recalled by Hofer, the Austrian partner of Aldi. The chocolate, which was sold at Aldi Süd from December, is produced in Turkey, which is noted on the back of the packaging.
The court did not see in the previous labeling that the chocolate actually came from Dubai. The judgment means that Aldi Süd is currently no longer allowed to sell the chocolate. In the future, the name "Dubai chocolate" only has to be used if the product has actually been produced in Dubai or has another geographical reference. The confectionery importer Andreas Wilmers complained in court after taking similar steps against Lidl and Lindt, who have so far been without a final decision. Lindt, however, emphasizes that the term "Dubai chocolate" only serves as a variety of varieties for chocolate with specific fillings and does not necessarily indicate the place of origin, as Spiegel.de
the media hype about the Dubai chocolate, favored by social platforms such as Instagram and TikTok, contributes to the high demand. Despite the legal disputes, it remains to be seen how the market will react to this development and whether Aldi can finally meet the legal requirements of its products.
