Investigations against AUA security chief: Abuse of office in focus!

The legal investigations are expanded almost ten months after the hailstan weather, which damaged a machine from the Austrian Airlines (AUA). The Vienna public prosecutor's office has initiated investigations against the head of the Federal Security Investigation Agency (SUB) and against six other people. There is suspicion of abuse of office, promotion and evidence suppression, but this suspicion is not weighted equally in all suspects. On June 9, 2024, the Airbus A320 of the AUA got into a storm cell on the return flight from Palma de Mallorca and had to make an emergency call "Mayday". Fortunately, the machine landed safely at Vienna-Schwechat Airport, with no injuries to complain about the passengers, but the machine suffered severe damage.

The Viennese indictment checked the initial suspicion and initiated an investigation.

Investigations and reports

In the interim report of the SUB, the incident is classified as a "incident", while international private reports speak of a "serious accident". List List sharply criticized the SUB because she prevented the publication of the cockpit voice recorder and data storage. The head of the sub and the other suspects have given the relevant procedures, which also complicated the investigation.

The cockpit voice recorder and the flight data writer have not yet been evaluated. The Vienna Higher Regional Court will have to decide whether the securing of these records was legal. In the meantime, the Korneuburg public prosecutor continues to examine the allegation of negligent community hazard. An end to the investigation is not yet foreseeable due to the scope of the surveys.

The context of the investigation

The Federal Office for Flight Accident Investigation (BFU) is responsible for the investigation of accidents and serious disorders with civilian aircraft in Germany in accordance with Regulation No. 996/2010 and the flight accident investigation law. According to bfu , the examination is more independent of the judicial or administrative procedure, and the reports are used for accident prevention without making any findings.

The BFU is involved in cases abroad if the affected aircraft has been registered, manufactured or operated in Germany. The investigations aim to gain significant knowledge of aviation safety and are not directly bound by the result of legal procedures.
