In Hebertshausen, a new medical center with a total area of 750 square meters for medical and therapy practices as well as another 750 square meters of living space is planned. The construction is scheduled to begin this year to ensure medical care in the region. Although there is no acute shortage of doctors in the village, the medical infrastructure has been tightened by the since the closure of a pharmacy in 2017, which is due to profitability reasons. High requirements of the Pharmacy Staff Act make it difficult to open a new pharmacy.
The local council has expressed the wish to find a solution to the drug care that is also accessible for less internet season. Information events for interested doctors took place last year, and there is already a group of interested parties consisting of two general practitioners as well as psycho and physiotherapists. There is also a challenge in the lack of medical-technical staff, which is why it is the goal to make the medical center attractive to medical staff. Sustainable construction and personal areas used are part of the planning.

The planning for the medical center has been underway since 2018, with the original location in the town center being moved to Krautgartenstrasse. The approved plans include two buildings: a medical center with a medical industry on the lower floors and four apartments on the third floor and another pure house. The discounted living space is linked to income limits: individuals may achieve a maximum income of 28,300 euros, while this amount is 43,200 euros for two. For each child, the limit increases by 3,200 euros. Despite these requirements, there is a low response to the interest in the apartments offered, which is why fewer feedback than originally expected.
The tender for construction companies ends in mid-January, and the end of the bidding round is expected until March or April 2025. The location of the new medical center and house is 300 meters from the new wooden grinding shop, where a new residential area will be built.
In a corresponding legal case, the Federal Court of Justice (BGH) decided that partial owners have to refrain from using their units for residential purposes in a commercial home. The building in question, which was originally intended for work -related use, consists of seven units, including medical practices and a pharmacy. The defendant, who had converted a former doctor's office into living space, was faced with the termination of his tenants after the establishment of a new medical center nearby.
Currently only three units are used as medical practices, while other units are partially rented or empty. Several sub -owners asked the defendant to refrain from using apartments. A district court initially dismissed the lawsuit, but the district court later took place and condemned the defendant. The BGH now rejected the defendant's revision and found that the use for residential purposes was not compatible with the existing community order. Residential use was considered more disturbing than the original professional use, which underlines the legitimate interest of the partial owners in the preservation of the professional building character.
Although the defendant could possibly be entitled to adaptation of the community order to enable use for residential purposes, the BGH emphasized that this claim had to be enforced. An assertion of the adaptation claim could not be used as an objection to the injunctive relief. The BGH also made it clear that compliance with the existing community order is necessary until a legally binding judgment, which illustrates the importance of the clear regulations for the use of partial property in industrial buildings.
