Bloody discussion in the Scheibbs district: Court speaks judgment

In one night that did not go as planned, tensions in front of a restaurant in the Scheibbs district led to a bloody argument between two men. A 42-year-old and a 23-year-old man stood in front of the St. Pölten regional court due to mutual severe bodily harm.

The events took place on the night of July 28, when the two men who had not previously known themselves were involved in a heated word for words. The exact circumstances of the escalation initially remained unclear, not least because of the alcoholization of both opponents. According to the first reports, there were violations after a normal conversation.

A witness brings new knowledge

The defender of the 23-year-old, Johann Huber, pointed to a witness that was supposed to assert the innocence of his client. In the meantime, the previous 42-year-old's lawyer gave to understand that he would guilty. The statements of these participants caused confusion because the descriptions were difficult to understand.

Finally, beer glasses flew, with the glass of the 42-year-old hit the face of the 23-year-old and added a heavily bleeding wound to the eyebrow. It turned out that the thrower may also have been injured, but the proof was missing because he quickly removed from the scene and the injury was not documented.

The judge's assessment

A witness, the 42-year-old's nephew, stated that his uncle threw the beer glass specifically against the 23-year-old. However, the 23-year-old waited almost a minute before he threw his glass away because he could hardly see due to the bleeding. The crushing glass hit a bike parked nearby. The witness noticed no injuries to his uncle.

In the course of the trial, judge Andreas Jungbauer decided to follow the acquisition for the 23-year-old, and emphasized that the witness had made a significant contribution to clarifying the case. "That was a open-air class," commented the 42-year-old lawyer, Bruno Bernreitner, in relation to the alcoholic influence on those involved. It was agreed that the 42-year-old should receive a conditional prison sentence of 18 months as part of the decision and the payment of pain and suffering in the amount of 700 euros.

The prosecutor initially made no explanation, which means that the judgments are not yet final. This argument not only shows the problems that can arise from alcohol and misunderstandings, but also emphasizes the role of witnesses in legal disputes.
