On a night that didn't go as planned, tensions outside a bar in the Scheibbs district led to a bloody confrontation between two men. A 42-year-old and a 23-year-old man appeared before the St. Pölten regional court on charges of mutually causing serious bodily harm.

The events took place on the night of July 28 when the two men, who had not previously known each other, became embroiled in a heated exchange. The exact circumstances of the escalation initially remained unclear, not least because both opponents were under the influence of alcohol. According to initial reports, a fight broke out after a normal conversation.

A witness brings new insights

The 23-year-old's defense attorney, Johann Huber, pointed to a defense witness who would protest his client's innocence. Meanwhile, the lawyer of the 42-year-old, who has a previous conviction, made it clear that he would plead guilty. The statements of those involved caused confusion because the descriptions were difficult to understand.

Finally, beer glasses flew, with the 42-year-old's glass hitting the 23-year-old's face and inflicting a heavily bleeding wound on his eyebrow. It turned out that the thrower may also have been injured, but there was no evidence because he quickly left the scene and the injury was not documented.

The judge's assessment

A witness, the 42-year-old's nephew, stated that his uncle deliberately threw the beer glass at the 23-year-old. However, the 23-year-old waited almost a minute before throwing away his glass as he could barely see due to the bleeding. The shattered glass hit a bicycle parked nearby. The witness did not notice any injuries on his uncle.

During the course of the trial, Judge Andreas Jungbauer decided to accept the application for an acquittal for the 23-year-old, emphasizing that the witness had made a significant contribution to clarifying the case. “That was a drunken story,” commented the 42-year-old’s lawyer, Bruno Bernreitner, in reference to the alcoholic influence on those involved. It was agreed that, as part of the decision, the 42-year-old should receive a conditional prison sentence of 18 months and payment of compensation of 700 euros.

The public prosecutor did not initially make any statement as to why the verdicts are not yet final. This confrontation not only highlights the problems that can arise from alcohol and misunderstandings, but also highlights the role of witnesses in legal disputes.
