One-person companies (EPU) often find themselves unprepared when unexpected emergencies occur. This is a central topic that was addressed in a series of events focusing on practical legal precautions. More than 150 entrepreneurs have already taken part in these events in Spittal, Völkermarkt and Klagenfurt, which outline aspects such as wills, inheritance law, health care power of attorney and living wills. Chamber of Notaries President Werner Stein emphasizes that one's own responsibility for the existence and customers plays a central role for EPU. “Forward-looking planning creates security,” says Stein. Consumers should take this issue seriously in order to clearly regulate their wishes in the event of incapacity or after their death. The necessary pension documents often depend on the individual life situation. The latest findings also include a list of seven important pension documents that everyone should know:

• Generalvollmacht: Umfasst umfassende Regelungen für rechtliche und wirtschaftliche Lebensbereiche, besonders für Unternehmer wichtig.
• Betreuungsverfügung: Bestimmt, wer als gesetzlicher Betreuer bestellt wird, falls die bevollmächtigte Person ausfällt.
• Organspendeausweis: Kann in der Patientenverfügung oder der Vorsorgevollmacht festgelegt werden.

Important details concern the creation of a will. In order to effectively draw up a will, you must have testamentary capacity, which is the case from the age of 16, provided there are no mental limitations. Wills can be drawn up both in personal form, which must be written and signed by hand, and in public form. Any formal missteps could render the document invalid, leading to intestate succession. Attorney Thorsten Klinkner emphasizes the negative consequences of a lack of planning; 28% of all civil law disputes concern inheritance. The creation of a will ideally takes place in several phases, starting with clarifying the goals through to taking special situations such as company succession into account.
