Neighborhood dispute in court: Doctor complains about handicrafts

A confused neighborhood relationship could recently be considered at the Korneuburg regional court. The 52-year-old doctor from the Korneuburg district was faced with serious allegations. The incident that occurred on October 7 of last year concerns a alleged threat to his 64-year-old neighbor and the theft of her cell phone.

On this first day of the negotiation, the judge Franz Furtner was confronted with two perspectives: the indictment that spoke of a dangerous threat, and the doctor's defense, who insisted innocence. In his defense, the newly elected lawyer, Philipp Winkler, believed that there was a dispute between the neighbors for whom the doctor wanted to take responsibility.

The incident and the legal consequences

Winkler said in court that the doctor should have taken the neighbor's cell phone, but this did not happen out of an intention to enrich itself. Instead, his goal was to prevent the neighbor from alerting the police. He disposed of the cell phone in a dung bucket, which in the defense lawyer does not meet the serious accusation of the robbery, but only that of permanent deprivation of things, since the cell phone is lost forever. The doctor himself emphasized that in the heated discussion, unfriendly words had fallen during the incident. So it happened that the neighbor was annoyed because the 64-year-old had accused him of as an alcoholic with the police, while she was annoying to the doctor because this police visit was unpleasant.

according to the arguments presented and due to the fact that a repetition of the incident should not be feared, judge Furtner discussed the future relationship between the two neighbors. The doctor said that he was happy to avoid contact with his neighbor again and planned to move in the following spring. The judge saw this planned change as advantageous.

As part of the procedure, there is now a diversion that means a penalty of 6,000 euros plus 660 euros for the doctor. The 52-year-old agreed to these legal consequences, which indicates that he accepted the emerging challenges.
