Aua lagy: Public prosecutor is investigating chief security for security!
Almost ten months after the hailstick, which a AUA machine significantly damaged, the Vienna public prosecutor expands its legal investigations. Since the incident on June 9, 2024, when an Airbus A320 got into a storm cell on the return flight from Palma de Mallorca to Vienna, the responsible persons are in focus. The machine gave an emergency call ("Mayday"), but was able to land safely at Vienna-Schwechat Airport. Fortunately, there were no injuries among the passengers, while the machine itself suffered severe damage. According to OE24 , the head and six other persons of the federal security investment agency are now being investigated due to suspicion of office abuse, favoration and evidence suppression.
The investigation is rapidly absorbed after cockpit voice recorder and flight data clerk in the Ministry of Transport were confiscated three weeks ago. The sub had not published it voluntarily. Passenger attorney Wolfgang List had previously brought in a presentation of the fact that he suspected corruption and other crimes. The Vienna Anktion Authority reacted to this situation, which examined the initial suspicion and initiated an investigation. In the SUB intermediate report, an "incident" and not of an "accident" are spoken-an assessment that is sharply criticized by lawyer List. He accused the SUB to prevent the publication of the cockpit voice recorder and the data storage.

The procedures concerned were given both by the head of the sub and the other suspects, which makes legal clarification more complicated. International private reports certify this case as a "serious accident". The cockpit voice recorder and the flight data recipient have not yet been evaluated, which also hinders the investigation. Furthermore, the Vienna Higher Regional Court must decide whether to ensure these records.
The public prosecutor's office in Korneuburg is also employed with the accusation of negligent community hazard. An end to the extensive investigation is not yet foreseeable. The complexity of the case is also shown in the legal framework conditions, which are defined by the Federal Office for Flight Accident Investigation (BFU) . According to Regulation No. 996/2010 and the flight accident investigation law, the BFU is responsible for the investigation of accidents and serious disorders with civilian aircraft.
The BFU pursues the purpose of accident prevention and only examines events if they can be expected to have significant knowledge for aviation safety. It is important to emphasize that the BFU reports do not contain any findings on guilt, liability or claims and are regardless of the judicial or administrative procedure.
