Until then, the principle of presumption of innocence must apply. Curiously, the defense of Berktold calls for a prison sentence of only two years and six months, although a conviction of more than a year would lead to Berktold automatically losing his office.

At the same time, a disciplinary procedure is running against him. Despite the preliminary administration of the Bavaria State Prosecutor's Office, this procedure remains in the balance until the criminal proceedings have been completed.
