Stay calm or escalate? When drivers take up arms!
In a dramatic incident in Vienna-Alsergrund, a 68-year-old man pulled out a gun and pointed it threateningly out the window of his vehicle after he was ignored by a 41-year-old driver while changing lanes. The 41-year-old reacted immediately, fled the situation and alerted the police State Police Directorate reported. When the 68-year-old was subsequently checked at home, the police discovered that the weapon was a Category B handgun. He had the relevant weapons law documents, but was reported on suspicion of dangerous threats and received a temporary weapons ban. The 41-year-old is also being reported because of his threat from the incident.
Coercion in traffic
The danger of such situations is made clear by the general legal situation on the subject of coercion in road traffic. Pushing and following too closely can have legal consequences if it appears to be coercion. Loud ADAC Coercion is a crime that occurs when someone is forced to change their behavior through the threat of violence. In cases like this, one could argue that the 41-year-old was not only threatened with a weapon, but also put under pressure to refrain from overtaking. The penalties for such acts are significant, ranging from high fines to driving bans and, in the worst case, the revocation of your driving license.
The legal situation makes clear the importance of consideration and safety in road traffic. Not only are these incidents frightening, but they can also have serious legal consequences for those involved. An overview of similar judgments shows that the courts take such aggressive behavior seriously and punish it accordingly.
