Staduklungshof confirms correct rededication in the Breitenlee case

The cause around the allotment garden association Breitenlee still causes discussions even after one year. A current report by the Stadukunient Court (StrH) has now clarified: The redesign of the area was carried out legally correctly. The ÖVP had previously called for an examination of the processes to uncover possible politically motivated influences.

In the summer of 2020, the district head Ernst Nevrivy (SPÖ) acquired a property in the allotment garden area, which was later converted into building land in 2021. This decision led to a significant increase in value of the property and was intensively observed by the opposition. The report of the StrH now confirms that there was no evidence of influence or inadmissible interventions on the part of the SPÖ.

The role of public prosecutor's investigation

The Vienna public prosecutor's office had started investigations against Nevrivy and other people in March. However, a preliminary report ruled out the possibility of criminal acts against three other affected people in July. Nevrivy's lawyer confidently commented on the legal correctness of his client.

The ÖVP, which had requested the exam, had already referred to the Causa as the "SPÖ shaft pond" at the beginning of the affair. However, the now results of the 110-page report of the strh are not surprising for the Viennese ÖVP. The report stated, among other things, that the MA 21 office for district planning and area dedication correctly complied with all regular procedures and that no other SPÖ officials were active in the dedication procedure.

It is interesting that the need for a dedication procedure was first discussed in 2006. Since then, there have always been efforts by the allotment garden association to devote the area for all year round. Talks with the authorities and the district head took place from 2011, but first had to be waited for the planning of important traffic projects before the dedication process could be finalized.

The purchase contracts for the relevant plots were concluded between 2016 and 2020, which illustrates the extent of the debate about the congruence of political actions and property sales. Although the allegations of the political influence have now been officially declared unfounded, the discussion about the integrity of political decisions and their influences on urban resources remains.
