In a sensational case, an 87-year-old woman from the Braunau district, who suffers from a dementia disease, won in a legal proceedings against the pension insurance institution (PVA). Despite her demonstrably significant need for care, your care allowance was initially set at level 2. This did not correspond to the actual maintenance effort, reported the Upper Austria Chamber of Labor. Her daughter, who took care of the elderly mother, intervened after the PVA rejected an increase in the care allowance. As a result, the Chamber of Labor brought the case to court. The medical assessment showed that the woman needs more than 180 hours of care per month, plus an exhaustion surcharge of 45 hours. Through this successful use, the woman was finally classified into the highest care level, level 5. "If notices do not meet the state of health and the care needs of those affected, our members and their relatives can rely on the legal support of the AK," said AK President Andreas Stangl.
