Redesign of cell phone security: Focus on the effects of the Constitutional Court decision
A panel discussion in the Austrian Parliament examined the topic of cell phone security from the perspective of criminal investigation work and fundamental rights requirements. This discussion was held in collaboration with the Austrian Lawyers' Conference. In 2023, the Constitutional Court declared the current provisions unconstitutional, which requires the matter to be redesigned by the beginning of January 2025 at the latest.
According to Constitutional Minister Edtstadler, intensive discussions are still underway to reorganize data security. An initiative proposal is to be submitted to the National Council this week in order to be able to use the remaining time until the end of the year. The Ministry of Justice also plans to submit a practical draft that complies with fundamental rights as soon as possible so that it can be passed this year. According to Marcella Prunbauer-Glaser, President of the Austrian Lawyers' Association, a non-decision by the legislature would have "unprecedented consequences in criminal prosecution."
It is important to push forward a new regulation of cell phone security in order to support educational work in the criminal area and to adequately take fundamental rights requirements into account. The panel discussion in Parliament showed that intensive discussion of this issue continues in order to find a legally secure solution.
