In Mülsen, in the Zwickau district, district employees seized several weapons and ammunition. The weapons belonged to a 41-year-old whose firearms permit and hunting license had previously been revoked. When searching the property, the officers also found numerous drugs, including crystal, hashish, marijuana, ecstasy tablets and LSD trips worth around 7,000 euros. The 41-year-old suspect was temporarily arrested and taken to a correctional facility (JVA). An arrest warrant was issued against him.
The man is suspected of dealing in large quantities of narcotics. What makes matters worse is that weapons have been accessed. During the operation, a 49-year-old was also found who came to the scene in an unstamped vehicle. He was driving without a driver's license and was reported for driving without a license and violating the compulsory insurance law. Officers from the Zwickau police department, riot police and employees of the police administration office were involved in the operation.
Legal classification of drug trafficking
The incident in Mülsen also raises legal questions, particularly with regard to drug criminal law. Section 30a Paragraph 2 No. 2 of the Narcotics Act (BtMG) punishes armed trafficking of narcotics in large quantities with a prison sentence of at least five years. Anyone who carries a firearm or other dangerous objects that are capable of injuring people is considered armed.
With regard to the classification of knives in drug trafficking, the Federal Court of Justice (BGH) has made it clear that knives that are not prohibited can also be viewed as weapon-like objects in drug trafficking. In this specific case, it was found that a non-prohibited switchblade can give rise to criminal liability for armed trafficking if it is capable of injuring people. This could also be important for the current case in Mülsen.
