federal police officers caught a couple during sexual intercourse in the main train station in Gelsenkirchen, North Rhine-Westphalia on Wednesday night. The two 19-year-olds, a man and a woman, are now being investigated for excitement of public annoyance.
The couple's discovery took place through the video surveillance of the train station. When the officials arrived, the man and the woman closed her pants. At the subsequent survey, the 19-year-old did not provide any information about the events. An evaluation of the surveillance cameras showed that the couple had previously performed sexual acts on a staircase in the train station.

According to the legal framework for "public excitement", it is a sexual act that takes place in public and violates people in their views. The legal text of Section 183a of the Criminal Code describes the fact as: "Whoever performs publicly sexual acts and thereby deliberately or knowingly annoyed ...". It should be noted that the individual circumstances are crucial for the assessment.
The legal foundations require that the observing people feel repelled and seriously injured. Intimities in closed groups, for example on nudist beaches or in swinger clubs, are not under the excitement of public annoyance. The investigation checks whether the perpetrator can be accused of, and the obligation to provide evidence lies with the accusing authority, i.e. the public prosecutor.
The presence of a public annoyance can therefore be given on different occasions, such as an intimate meeting in the car, if this is perceived by a person who feels injured. The whole thing is treated as an official offense, which is why the authorities have to determine in such cases. The punishments range from fines to one year of imprisonment.
A corresponding judgment in the "extended certificate of good conduct" can be noted for those affected. However, actions that are only considered to be grossly offensive or harassing do not lead to an entry. If the observing people consent to the situation, there is no criminal liability.
