Rainbow camp in Prerow: Legal dispute over evacuation escalated!
Prerow, Deutschland - The legal disputes about the rainbow camp at Prerow in Mecklenburg-Western Pomerania are tipped out. Regenbogen AG has considerable doubts about the proper implementation of the selection process for a new operator of the campsite. In a negotiation before the Stralsund district court on Wednesday, the legal representatives of Regenbogen AG and the country exchanged their views, but were unable to get any agreement. A judgment in this procedure is expected on February 5, 2025 after a quality proposal that Regenbogen AG voluntarily rejects the campsite after the ongoing company this year.
Regenbogen AG criticizes the selection process as illegal and non -transparent. The state as well as the Environment and Nature Conservation Foundation Mecklenburg-Western Pomerania, on the other hand, consider the procedure as an ideas competition without claiming a lease. Camper’s Friend GmbH from Hamburg was determined as a potential winner of the procedure, but no lease agreement has so far been signed with her. With its concept for the national park of the campsite, Regenbogen AG only reached third place. In further legal steps, Regenbogen AG defends itself against the expression of interests, while the foundation was already successful with an eviction action and successfully cleared parts of the site in the dunes, such as ndr reported.
previous court decisions
The dune campsite is also the subject of further legal disputes. On October 14, 2024, the Rostock district court decided on an eviction lawsuit by the Environment and Nature Conservation Foundation, the said that parts of the site must be cleared by Regenbogen AG. This judgment is currently not yet final, but can temporarily be enforced if a security deposit of two million euros. The lease agreement between the state and Regenbogen AG ended on December 31, 2023. A clause says in the contract that it can be negotiated or terminated by the federal government in the event of the area of the area. The presiding judge Till Halfmann found that Regenbogen AG is not entitled to an update of contract, but at most for compensation.
Tilman Giesen, lawyer of Regenbogen AG, announced that he wanted to go into appeal and expressed the impression of expropriation. Environment Minister Till Backhaus (SPD) welcomed the judgment and made it clear that permanent campers can keep their parking spaces. There are a total of four mutual complaints between the state and Regenbogen AG, and the Stralsund district court will decide on November 26, 2024 on a second eviction lawsuit. The administrative courts in Greifswald and Schwerin also deal with various aspects of the case, and the Rostock Higher Regional Court is also included in the appeal procedure.
