The accused also argue that the public prosecutor's claims, according to which all road users are informed in registered demonstrations, do not comply with reality. A policewoman who filed a complaint at the workplace due to a delay of 39 minutes confirmed in court that she rarely informs herself about possible disorders and is often stuck when demonstrations take place.
If the judgment would be legally binding, all demonstration participants could be charged with delays in traffic! This would mean that the state decides on when and where to be demonstrated - and that would be unconstitutional, according to the “last generation” argument. In addition, six other Marburgers are again under indictment for coercion due to a protest on March 31, 2023 in Gießen, near the “Oswaldsgarten” railway. The situation comes to a head!
