A shocking case of neglect has caused a stir in Schweinfurt: a 16-year-old girl died of malnutrition and the parents were found guilty, but the court decided not to impose any punishment on them. The 51-year-old father and 48-year-old mother already bear the heavy burden of loss, which the court considered sufficient punishment. The tragedy occurred on December 19, 2022, when the girl died of multiple organ failure caused by extreme malnutrition. Her body weighed only 19 kilograms and was described as “a skeleton with skin and bones.”

Parents under pressure: Inadequate medical help

The parents, a teacher and a technical worker, were on trial for failing to seek medical help for their severely underweight daughter. The indictment included serious allegations such as abandonment and attempted murder. During the trial, the parents stated that their daughter did not want to go to the hospital due to an anxiety disorder and they were unable to force her to do so. They were unaware that their daughter's condition was life-threatening.

The public prosecutor's office demanded a conviction for attempted murder and a suspended sentence of two years. But the court decided that the consequences the parents had already suffered were so severe that additional punishment would not be appropriate. The judges referred to a section of the criminal code that states that punishment can be omitted if the consequences of the crime for the perpetrator are so serious that punishment appears inappropriate. The defendants waived their right to appeal and the verdict is not yet final.
