Modern Building GmbH insolvent again – restructuring failed!

On November 19, 2025, “Modern Building GmbH” filed for bankruptcy again. This became necessary due to the non-fulfillment of a quota from a restructuring plan, which means that the company is finally insolvent. The insolvency proceedings were opened at the Salzburg Regional Court, as reported by 5min.at.

“Modern Building GmbH”, based in Obertrum am See in Flachgau, is active in real estate development and is now faced with considerable financial difficulties. Insolvency proceedings were already pending in 2023, in which liabilities of around 1.4 million euros were identified. A restructuring plan that called for a repayment of 25 percent of the debt could not be implemented.

Current situation and procedures

The company's current assets consist of two undeveloped but encumbered properties. The unrepaid liabilities from the preliminary proceedings have become active again. In addition, Modern Building GmbH can no longer meet its ongoing payment obligations, so bankruptcy proceedings have been initiated. Creditors are now requested to register their claims with the court, and support is offered with these registrations, as akv.at informs.

The services offered range from attending necessary court dates to out-of-court resolution of debt disputes. The collection and forwarding of the quota allocated to the claim is also supported by specialized bodies. What is remarkable is the opportunity for creditors to register claims up to an amount of 3,000 euros free of charge, with only a court fee of 31 euros to be paid.
