SPÖ goes to the Constitutional Court: election fraud in Kematen with consequences!
In Kematen, the SPÖ came up with outrageous allegations: According to a statement, there were serious irregularities during the voting process with voting cards. Eligible voters are said to have been observed and put under pressure while voting. In addition, the party complains about a lack of proof of identity and the unlawful issuing of voting cards, such as noe.ORF.at reported. Despite the confirmation of at least 15 illegally issued applications by the state election authority, it denies that the violations influenced the election results. The SPÖ local party leader Matthias Fischböck is outraged by this and speaks of a “fundamental attack on our democracy”.
Legal dispute before the Constitutional Court
In view of this situation, the SPÖ is taking the matter to the Constitutional Court (VfGH) to challenge the legal conduct of the election. The mayor of Kematen, Juliana Günther from the ÖVP, describes the SPÖ's actions as “incomprehensible” and calls for an end to the disputes so that the municipality can concentrate on its work. Apparently, according to the mayor, there are accusations from the SPÖ after every election, which shows that other issues should be dealt with intensively, as reported mydistrict.at.
Currently, going to the Constitutional Court has no immediate impact on the community, as the local council must be constituted within four weeks. While Kematen is confronted with this legal dispute, the state's main electoral authority has already announced in other municipalities where irregularities were also found, such as Marchegg and Gablitz, that new elections will be held in some cases. These anomalies did not lead to the confirmation of the previous election results because the voting process was not carried out correctly.
