Two years ago, a man from Vorarlberg had a fatal experience with his e-scooter on the way to work. During a braking maneuver, he slipped on the wet road and injured himself. The case went all the way to the Supreme Court, which ruled that the accident had to be classified as “vehicle-specific,” meaning that the special characteristics of the e-scooter, such as the small wheels and unstable chassis, were relevant. While a similar incident with a bicycle would have confirmed the right to workers' compensation insurance, the Supreme Court viewed the e-scooter as an unusual means of transport in which the recreational nature predominates.
Legal consequences and insurance issues
This decision has far-reaching consequences. The demand for e-scooters has increased rapidly, but the number of accidents has increased fivefold in the last five years. Experts like Jürgen Wagner from the ÖAMTC warn of the risks and recommend a particularly careful driving style. At the same time, the legal classification of e-scooters is unclear; they are viewed as recreational devices, while drivers must behave like cyclists on the road. Jürgen Wagner recommends taking out private accident insurance that offers comprehensive protection and checking your existing household insurance for any liability coverage.
Negligence also plays a major role in accidents.
