An incident in Vienna that has caused a stir in the past few days affects a legal guardian who was in court on Friday. The reason for the process was the events around the flight of an investigation in February, which caused many questions.

The official was not accused of escape, but because he mistakenly claimed that the prisoner had attacked him with a fist. Video recordings from a surveillance camera proved that this was not true. The crimes "abuse of the authority" and "defamation" were accused of the judicial forces. He admitted that he had made this wrong information from "shame", as this had happened to him for the first time in his 20-year career. Due to its open debt, it was agreed on a diversion, which set the procedure after payment of a fine of 4,000 euros.

The affected prisoner, then 19 years old, was imprisoned after a conviction for robbery and assault and was in custody due to investigations into suspicion of terrorism. He was originally housed in the Wiener Neustadt judgment, but due to an illness he was moved to the Josefstadt prison. On February 1, he suffered an epileptic seizure and was brought to the hospital of the Barmherzigen brothers in Vienna-Leopoldstadt for an investigation.

According to the instruction of the senior physician of the hospital, the prisoner should not be transported in handcuffs, since there could be a danger to life if he should overthrow. The legal guardian reports that the transport was initially easy. But when she climbed into the elevator and the officer pressed the button, the prisoner managed to free himself and escape. The officer tried to follow him, but fell at the main entrance of the hospital, which enabled the prisoner to escape.

The 47-year-old's persecution campaign proved to be unsuccessful because the prisoner could only be re-caught in Vienna-Floridsdorf the next day. As a result, the judiciary was approached by his superior when he pulled a head injury. To justify himself, he stated that he was attacked. In addition, disciplinary proceedings could be initiated against him. Previously, a disciplinary penalty over 500 euros had already been imposed because he had failed to put on handcuffs to the prisoner.
