Court lifts the lock: Benko's founder rights remain unaffected!

In a sensational legal dispute over the foundations of the former billionaire René Benko, the Higher Regional Court of Innsbruck recently stopped an injunction, which restricted his mother Ingeborg Benko's donation rights. This decision enables the mother to continue to fully exercise her rights in the private foundations of Laura and Ingbe. According to the insolvency administrator Andreas Grabenweger, the founder rights have meanwhile become "practically frozen", which is no longer the case, such as Puls24 reported .

The mass administrator's lawsuit is based on the assumption that René Benko always had actual control over the foundations and his mother only acted as a "straw woman". One suspects the parties involved in a possible “asset veil”, since a fortune in the three -digit million range is suspected in the foundations. Despite the difficulties in the bankruptcy application, which has previously accepted claims of 47 million euros, Grabenweger and his law firm continue to fight for complete control, such as ORF Tirol .

Litigation and effects

The injunction from the beginning of the year was supposed to authorize Grabenweger to take over the legal functions of the mother. However, this measure has now been canceled, which complicates the current legal situation regarding the foundations. The bankruptcy proceedings against Benko, which opened in March 2024, could take years, which should cause blatant problems for the creditor. So far, creditors have claimed claims of 2 billion euros.

In addition, it is considered uncertain to what extent the luxurious lifestyle of Benkos, among other things financed by the foundations, can continue to be maintained. The villa in which Benko lives, as well as the hunting area in which it can be seen frequently, are also part of the foundation's assets and could play a crucial role in the upcoming jurisdiction.
