New construction error package: Support for existing living space in Upper Austria
In Upper Austria there are exciting news for the owners of real estate who have construction errors. The ÖVP and the FPÖ brought a so-called "construction error package" into the state parliament. This is not a program for the legalization of black buildings, as Deputy Governor Manfred Haimbuchner from FPÖ and State Councilor Markus Achleitner from the ÖVP emphasize. Instead, this new set of rules enables construction errors to be remedied through high compensation payments in the future, which is ultimately intended to secure the existing living space.
The planned compensation payments that were set in the office of the residential building officer Haimbuchner should be twice the usual square meter price. This not only creates the legal framework for permitted buildings, but also opens up the possibility of taking special provisions into account such as distance rules to the neighbors.
regulations for construction errors
It is important to mention that the regulation does not apply to all types of construction workers. In fact, complete "grassland buildings" and those without original construction consensus, which are often referred to as "black buildings", are not affected by this regulation. Buildings that do not serve the residential or commercial purpose- such as garden huts or swimming pools- cannot fall under these new provisions.
"I would like to make it clear that this is not an amnesty law, but a solution that takes a close look at every individual case," said Haimbuchner. The focus of the new regulation is to support sensitive units that are decisive for the residents or for the practice of their business. Haimbuchner also expressed the desire to preserve families and companies from demolishing their buildings.
The initiative shows that the state of Upper Austria meets the needs of citizens, especially in times when living space is an increasingly valuable resource. While the practice shows that each construction project must be considered individually, the new regulations can consider the execution of the Spatial Ordinary Act and the building code.
