FPÖ Lower Austria saves 62,757 euros: Court stops misleading tavern letters!

Niederösterreich, Österreich - The FPÖ Niederösterreich managed to save the satirical magazine "Tagesspresse" over 60,000 euros by having the deadline to publish a judgment of the Supreme Court (OGH). According to OE24 , the "daily press" lost any claims to public publications that include a cost of 62.757 euros would have.

In February, the OGH ruled that the letters sent by the "Daily press" on behalf of the FPÖ Lower Austria represented a "conscious deception" and an "misleading and illegal publication". In these fake letters, which were sent to 500 taverns in April 2023, the “tavern bonus” introduced by the FPÖ was sharply criticized.

The controversial letters also contained a fictional "Department to promote patriotic eating culture" and mentioned specific criteria for the awarding of the premium, such as a "breadcrumbs" and a "red-white-red children's card" with special dishes, including the "Andreas-Hofer-Schnitzel" or "Gabalier-Feischlaberl". This procedure ensured the initiation of a legal dispute, through which the "daily press" in the first instance successfully sued the FPÖ what was decided by a commercial court in Vienna in March 2023.

However, the sheet turned: In this way, the Higher Regional Court (OLG) Vienna confirmed the decision in September 2024 and dismissed the FPÖ's appeal. This then submitted an extraordinary revision, which was ultimately decided by the OGH in favor of the FPÖ in May 2025, as effect of the judgment

As a result of the judgment ultimately in favor of the FPÖ, the "daily press" now not only has to bear the publication costs in regional media, but also the process costs of the FPÖ. Alexander Murlasits, State Partis Secretary of the FPÖ, described this judgment as a victory for the credibility in the political conflict and announced that it is intensively against fake news and false reports.

So far, FPÖ Lower Austria has not made any bookings on the regional media "NÖN" and "district leaves". The importance of the case remains of great interest in view of the legal disputes between a political party and a satirical publication.
