Who pays the rent after the separation? Clarity for Düsseldorf couples!
A spouse is undressing, and it is already boiling: Who pays the rent? A widespread misunderstanding is that the remaining partner is automatically responsible for the entire rent. But that's not the case! The pull -out is not obliged to bear the rental costs for the shared apartment as long as the divorce has not yet been carried out. Here you can find out what needs to be considered in a common rental agreement and what rights and obligations both partners have.
The year of separation is crucial! During this time, the apartment remains as a marital apartment, and both partners have the right to use them. The pull -out even has the right to return within the first six months. But be careful: after this period, this right of return expires, and the rental obligations remain. Anyone who is in the rental agreement remains responsible even after the separation. This means that the remaining partner, who is not in the contract, does not have to pay, but still runs the risk that the landlord will terminate the contract if the payments are terminated.
Who pays the rent in the event of a common rental agreement?
When both partners are in the rental agreement, they are liable together for the rent. Extract is not freed from responsibility! The landlord can request the full rent payment from both partners. If someone pays the entire rent, he can challenge half from the other. A court ruling has made it clear that the partner who stays in the apartment after the separation should also bear the rental costs alone. In the event of a joint termination, both partners must participate proportionately in the costs.
What happens if someone is in the rental agreement? The sole tenant remains responsible even after the separation. One solution could be that the partner not in the contract takes over the rental agreement. If the apartment is allocated judicially, the partnered partner can even request compensation for use. And what about the deposit? As a rule, this is not repaid because it is considered part of the family maintenance. Consulting solutions are the key here!
