Sunday ban for local buying in Rothemann: Listing threatened!

The Situation in Rothemann has changed abruptly for the customers of a close-up market. Stefan Reith, the operator of the small supermarket, received a decision from the administration of the Fulda district, which prohibits him from opening the Sunday. The ban is based on violations of the Hessian shop opening law, which regulates the sale on Sundays and public holidays. This measure comes into force immediately and if a punishment of up to 2500 euros is entitled if it violates the new requirements.

Stefan Reith was visibly affected when he opened the letter that thwarted his plans for Sunday. Its market, which is located on the heavily frequented B27, not only offered rolls, but also a variety of other foods for customers. The sudden closure on Sunday could have serious consequences for the operator, especially since he has been working in the region for almost 40 years and was dependent on this sales.

response to the ban

The closure on Sunday brings Reith into a precarious situation. He explains that sales on this day are of great importance for the existence of its market. He also employs eleven employees whose jobs could also be affected. "In order to be able to survive as a local supplier, I always looked for niches that helped me to remain economically stable," says Reith. The positive feedback from his customers who liked to buy his baked goods on Sundays was a great drive.

The situation became more critical after checking the commercial test service in August. During this examination it was found that not only baked goods, but also other goods were sold on a Sunday. Despite the years of practice, the sale in this form was not legally legitimate. Reith is disappointed with the legal interpretation and wonders why it was tolerated for 20 years.

The village community, represented by the mayor Oskar Kanne, also sees the Sunday opening as important for the local economy. "It would be a great support for Rothemann if we could fall back on such an offer. At least the baked goods would be important," he says. However, there is a clear conviction that the solution must be in accordance with the legal requirements.

Until further notice,

Reith sees no way to maintain the operation on Sundays. According to the district's decision, an opening on Sundays would only be legitimate if the backware counter makes the main component of the shop. However, since all other products are also available, he only has the refusal. The new legal regulations for fully automated supermarkets that can work under 120 square meters of sales area to open on Sundays show the differences in legislation. This could harm the small, family -run companies such as Reith's local buying.

In the eyes of Reith, the current regulation of its livelihood does not do justice, especially at a time when specialist retailers are faced with many challenges anyway. The closure of his market on Sunday could not only lead to financial losses, but may also endanger the future of the entire company. It remains to be seen how the situation will develop, but the jury in the region, similar to Reith, is very good at returning the Sunday openings.
