Bremen defends himself against walkway parkers: New concept ensures clarity!
The traffic authority in Bremen plans measures against the car parked on the sidewalk, a problem that has existed for years and increasingly leads to trouble among the residents. This initiative became necessary after residents had sued the sidewalk parking, which led to a judgment of the Federal Administrative Court. The focus is on quarters with the greatest need for action to ensure access for the ambulance and fire brigade, such as reported. Several measures are planned, including the creation of barrier-free sidewalks in downtown quarters this year, the expansion of the paid resident parking to entire districts as well as the establishment of car sharing stations and bicycle parking spaces. Quartier garages are also planned. Mobility Senator Özlem ünsal (SPD) emphasized a systematic and gradual procedure. Green politician Ralph Saxe supported the concept, but criticized the vague schedule. The next step will be that the parking concept is discussed in traffic deputation.
judgment of the Federal Administrative Court
The Federal Administrative Court had already decided on June 6, 2024 in a procedure that the defendant, the road traffic authority, is obliged to again decide on the applicants' applications. The plaintiffs are owners of houses on M.-Straße, B. Straße and T. Straße in Bremen, where they have been parked on the sidewalks for years. The existing sidewalks show widths from 1.75 to 2.00 m, which significantly affects the use, such as bverwg.de note.
The administrative law conflict began in 2018 when the plaintiffs already applied for measures against the sidewalk parking, but were rejected. The rejection was based on an administrative regulation that does not provide any additional traffic signs for legal regulations. The objection was also rejected. The administrative court then obliged the defendant to re -assess the applications and took into account the legal opinions of the Higher Administrative Court. Ultimately, the Federal Administrative Court found that the plaintiffs are entitled to a discretion -free decision, which further strengthens the current initiative of the traffic authority.
