A dramatic case of negligent killing shakes the Uecker-Randow region! The Pasewalk District Court has convicted two employees of an ambulance service who are held responsible for the tragic death of a 69-year-old patient. The incident occurred in March 2018 when the patient was thrown out of his seat on the way to dialysis due to an emergency braking because he was not strapped down.
Judge Gerald Fleckenstein made it clear that the two accused, 44 and 56 years old, had violated their duty of care. The patient, who already suffered from several previous illnesses and weighed 133 kilograms, suffered several rib breaks in the fall that led to internal bleeding. Despite these injuries, the accused initially brought him to dialysis and not directly to the hospital, which should turn out to be a serious result. "They should have prevented this as a crew of the vehicle," emphasized Fleckenstein in its reasoning.
Inadequate communication and quick follow
After the dialysis, the patient's condition deteriorated dramatically, which ultimately led to his death. A forensic medical appraiser said that the two major bleeding, which occurred shortly before his death, was the main cause of his quick death. "Faster treatment might not have prevented death," said the expert. But the inadequate communication of the transporters about the accident and its consequences could have been decisive.
The judge caused excitement in the courtroom when he went beyond the request of the public prosecutor and the two defendants sent fines of a total of 30 daily rates of 50 euros each. Despite the demand for acquittal by the defense, Fleckenstein left no doubt that the accused had a special responsibility. He also criticized the police who had failed to adequately inform the accused about their rights. The defense could nevertheless appeal to get another chance of acquittal.
