Investigations and searches in the focus

In another context, the legal framework for house searches were examined in more detail, especially how the law enforcement authorities in Germany are. As rosentreter & Scholz explain, house searches are serious measures that have to take place under certain conditions, such as a judicial decision. These are particularly relevant in the event of suspicion of serious offenses, including drug -related offenses or homicide. The interference with privacy requires both concrete suspicion and the compliance with legal standards to protect the fundamental rights of those affected.

In cases where there is a risk, for example to secure evidence, spontaneous searches can also take place. Nevertheless, the officials must always adhere to the norms of the Criminal Code in order to protect the rights of citizens. This underlines the importance of proper legal support in such critical situations.
