Homeless person is fighting for his HAS: Court rejects lawsuit!

Elsenfeld, Deutschland - A dramatic legal dispute between a homeless man and the municipality of Elsenfeld has heated the minds! The plaintiff, who has been without a permanent residence for some time, fights for the return of his personal objects, which have been stored in the community's rooms since 2022. Despite repeated attempts to get the things back, the man remained in the Zwickmühle because his current address is unknown and he did not accept an offered accommodation.

The situation escalated when the man pulled in front of the administrative court to sue the community. He argued that because of his homelessness and repeated hospital stays, he was unable to take care of his belongings. However, the presiding judge Gerhard Weinmann found that the community is not obliged to keep the belongings of a homeless person indefinitely. "You don't chat all the time, understood?" The judge called when the plaintiff kept trying to enforce his view. The lawsuit was ultimately dismissed and the court asked the man to sort out important documents before the municipality disposed of or sold the returned items.

The last opportunities

The court set a last period of two to three months to make a final decision. The plaintiff's lawyer pushed for more time for his client to have a permanent address, but the court remained tough: "In this case, there is no point in discussing another solution." The plaintiff, who called campsites, youth hostels and bus stops as his current overnight resorts, was frustrated with the short period. But the decision of the court is certain: the municipality of Elsenfeld is not obliged to store the man in the long run.
