New wind power opportunities: Bavaria waives bureaucratic hurdles!

Leutershausen, Deutschland - The Bavarian State Forests (BaySF) have relaxed the rules for the allocation of surcharges for wind turbines! In certain cases, they are now avoiding the elaborate bureaucratic selection process. A spokesman for the state forest revealed: "This is possible if suitable state forest areas are small or inappropriate so that they cannot be used for an independent wind project." For example, this affects cases in which only a few wind turbines could be built on adjacent state forest areas, while a wind farm is planned on a foreign ground

Many challenges! Sometimes the conventional selection process proves to be very helpful. There could only be a small expansion via existing wind farms on state forest landing, which makes the implementation of a competitive selection process superfluous. Instead, contracts can be negotiated directly with the developers on market conditions. But be careful: every such exception must be thoroughly checked and legally evaluated! The spokesman also emphasized: "We currently have five exceptional cases in mind." These make up a small part compared to the regular procedures.

The energy policy spokesman for the Greens in the Bavarian state parliament, Martin Stumpfig, was pleased with these changes. He believes that many municipalities can benefit from this new practice. An example of this is the municipality of Leutershausen in the Ansbach district, where priority areas are partly owned by the state forest. This makes the procedure enormously simplified and enables the municipalities to implement their projects according to their ideas.

But not everything is rosy! Stumpily warned of potentially exaggerated lease claims by the state forest. "If the lease claims are too high, the project could fail! We hope that the state forests will also be satisfied with a fair price." It was not until 2023 that a new award procedure was introduced, which provides for an extensive tender procedure for wind power -suitable areas, whereby municipal applications are often disadvantaged to financially strong investors. Therefore, it remains to be seen how these new exceptions will affect future wind power use!
