Dispute over daycare subsidies: City VS suffers legal defeat!
In the legal dispute between the city of Villingen-Schwenningen and the private day care center Kikripp, there was another defeat for the city administration. The Administrative Court of Freiburg decided on December 20 that the financial claims of the city, which amount to around 1.3 million euros, may be illegal. This decision could potentially have serious consequences for the city, since the claims for recovery could drive the kikripp into an existential crisis, such as reported .
The city had originally issued six administrative notices to reclaim grants from 2018 to 2023, as it considered it excessive. However, these demands were rejected on September 30, 2024 for formal reasons. The Kikripp had resisted with urgent applications and successfully argued that its interest in being spared from a possible bankruptcy outweighs the public interest in immediate execution. This averted an immediate closure of the daycare center, such as The Südkurier executed .
In a press release, authorized officer Marius Neininger from Kikripp asked the city administration to give explanations for their approach. He clearly expressed that the city had been responsible for years to properly clarify the claims instead of making exorbitant claims. This situation not only raises questions about the act of the city administration, but also shows the potential consequences for the Kikripp and the families concerned, which are dependent on continuation of the care.
