Stuttgart complains against the Railway Act: Housing construction in danger!
Rosenstein-Quartier, Stuttgart, Deutschland - Stuttgart is on the verge of a legal turmoil! The municipal council decided on Thursday evening with an overwhelming majority to sue the new railway law. This law blocks the construction of new apartments in the up-and-coming Rosenstein district, one of the most promising development projects in the city. The track surfaces behind the Stuttgart Central Station, which are released by the controversial Stuttgart 21 underground station, are in the sights of the city administration.
The decision to complain was supported by all major parties, including CDU, SPD/Volt, FDP, Free Voters, AfD and Greens. There were only eight votes against this step. Mayor Frank Nopper (CDU) had previously criticized the Reform of the Railway Act as unconstitutional and emphasized that the German Cities Day expressed similar concerns. The deadline for submitting the local constitutional complaint ends this year, and a renowned law firm has confirmed to the city that the lawsuit has good chances of success.
Stuttgart fights for living space!
The Railway Act only allows construction projects of "outstanding public interest" on the free -there are. However, the planned housing construction in the Rosenstein district is not recognized as such, which the city sees as a violation of its right to municipal self-government. Up to 5,600 new apartments could be built on the site, and a total of 7,500 apartments are planned in the Rosenstein district. This project could be the largest housing project in Stuttgart, which is supposed to make space for several ten thousand new residents.
With an area of 85 hectares, the Rosenstein district will not only offer living space, but also expand parks and green areas. The city plans to focus on local recreation and cultural connections. But whether this vision will become a reality depends on the legal disputes that Stuttgart is imminent in the coming months.
