Fight for fee: court gives employees right in sick leave!
A labor law scandal caused excitement in the Linz-Land district: a project manager was terminated during his sick leave, and his employer refused to continue to pay off the legally. The reason: the employer did not consider the sick leave to be sufficient, since it supposedly did not include an expected end of the incapacity to work. But the treating doctor could not say when the sick leave would end, which, according to the judgment, did not speak against the legality of the sick leave, as ots.at .
The Chamber of Labor (AK) campaigned for the rights of the employee and brought the case to court. The continued payment was granted in both instances, and ultimately the employer had to pay 2,350 euros. This clearly shows that employees should act quickly in the event of refusal to pay. As the AK President Andreas Stangl emphasized: "The case once again shows how important it is to quickly contact the Chamber of Labor if there are no payments." Another important aspect is that in the event of illness, employees are also entitled to continued payment of wages, which not only includes the wages, but also overtime and allowances. This is usually granted for a period of up to 12 weeks, depending on the duration of the employment relationship, such as the Chamber of Labor .
But what do those affected have to consider? Employees should be aware that the legal regulation for continued payment is complex: after a certain period of time, the amount of the payment is reduced, and the claim to sickness benefit from the health insurance company is decreasing if the remuneration is no longer paid. This shows how important it is to find out about your own rights during a sick leave and become active in time to avoid financial losses.
