Pothole album: occupational therapist falls and fights for compensation!
A dangerous pothole at the U1 station Kagran caused a painful incident for the 39-year-old icing therapist Cornelia K. On November 19, around 5:45 p.m., she fell as she crossed the busy tram tracks and overlooked the hole in the dark. According to Cornelia, she contracted two torn ligaments and a damaged tendon graft in the ankle in this fall. The medical treatment led to around 2,500 euros, and it has to stay on sick leave for at least eight weeks, while it hopes not to carry permanent consequential damage. The Viennese lines did not show any accommodation when they referred to their request for help - an employee, according to Cornelia, ignored and smoked them instead of calling rescue.
accident location and negligent bodily harm
The scene of the accident is considered to be heavily frequented, and the authorities only became aware of the damage after the fall. Cornelia reports that the pothole was quickly eliminated - a few days later the spot was newly paved. The lawyer Erich Sedelmayer, who represents the victim, believes that the Viennese lines should be liable for the accidents, since such dangers do not simply arise overnight. In its message, the Viennese lines emphasized that no defects were found during the last review in September. However, it is questionable whether this can be regarded as sufficient responsibility, while Cornelia must continue to pay for the treatment costs and possible consequential damage.
In her struggle for justice, Cornelia is now looking for witnesses who may have observed her fall and to reimburse the damage. The situation raises questions about the security at heavily frequented stops of the U1, the red subway line, which plays a central role in Vienna's public transport. The U1, which was opened in 1978 and has 24 stations, is known to be subjected to a regular review, as also reports Blog Vienna . Especially in these high frequency areas, security standards must be observed in order to avoid further accidents.
