Higher Regional Court raised judgment against briefly - false statements exposed!
Wien, Österreich - On May 26, 2025, the Vienna Higher Regional Court raised the judgment against Sebastian Kurz for false statements in the Ibiza investigation committee. The former Federal Chancellor had previously been sentenced to a conditional prison sentence of eight months, since he was accused of having given the impression that he had not been involved in the appointment of supervisory boards for the State Holding ÖBAG. However, the judge found that the objective fact of the wrong evidence was not fulfilled. This verdict is final, reported OE24.
The renowned criminal law expert Robert Kert commented on the topic in ZIB2. Kert, who defended the original judgment, emphasized the importance of the assessment of Kurz ’statements in overall context. He looked critically at the decisions of judge Michael Radasztics, who had found guilty in the first instance. Radasztics was proven with disciplinary penalty due to the passing on of secret information. According to Kert, neither the first instance judgment nor the acquittal was a clear thing and called for a rethink in dealing with celebrities.

role of the public prosecutor's office
The WKStA rejected a so-called "statement status" of Kurz, whereby the ex-chancellor denies the allegations and the presumption of innocence applies. The case has been going on for years and asks the question of the efficiency of the judicial system in cases of celebrities. The long process duration of four years is perceived by Kert as exceptional for a non -serious offense.
Overall, the course of this procedure remains of great public interest, not least because of the political position of Sebastian Kurz and the possible effects on politics in Austria. The developments here continue to be observed closely, since they could be formative for the legal framework in similar cases, such as the standard.
