Scandal about Aua: Investigations into abuse of office after hail accident!

Almost ten months after a hailstick weather that damaged a machine from the Austrian Airlines (AUA), the legal clarification of the incident is intensified. The Vienna public prosecutor's office is investigating the head and six other persons from the federal security investment agency (SUB). They are exposed to suspicion of abuse of office, favor and suppression of evidence, if not for all suspects to the same extent.

On June 9, 2024, the Airbus A320 of the Aua came into a thunderstorm cell to Vienna on the return flight from Palma de Mallorca. In the critical situation, an emergency call with the keyword "Mayday" was discontinued, but the machine landed safely at the Vienna-Schwechat Airport. Fortunately, there were no injuries among the passengers, but the machine was significantly damaged.

Investigations and confiscation

Last week, the Cockpit Voice Recorder and the flight data recorder in the Ministry of Transport were secured after the sub had not published them voluntarily. The passenger attorney Wolfgang List had previously submitted a presentation of facts with the Vienna public prosecutor, in which he suspected corruption and other crimes. The Viennese indictment then checked the initial suspicion and initiated an investigation.

In the interim report of the SUB, an "incident" and not of an "accident" are spoken. List List criticized the sub for preventing the publication of the important records. The head of the SUB and the other suspects have given their procedures at higher places.

International private reports certify a “serious accident”. The cockpit voice recorder and the flight data writer have not yet been evaluated. The Higher Regional Court of Vienna decides whether the securing of the records was legal.

The public prosecutor's office in Korneuburg continues to examine the accusation of negligent community risk. Due to the scope of the investigation, an end to the procedure is currently not in sight.

In the context of these investigations, it is relevant to mention that the Federal Aviation Accident Investigation (BFU) is active in accordance with Regulation No. 996/2010 regardless of the judicial or administrative procedure. However, the BFU reports do not contain any findings on guilt, liability or claims and serve primarily for accident prevention.
