On June 2, 2025, Vice Chancellor Andreas Babler (SPÖ) announced a new rental price brake, which should apply to the regulated housing market by 2027. The measures should in particular serve to promote affordable living in Austria. Since 2010, rents in Austria have increased by an impressive 70.3%, with an increase of around 25% in the past two years alone. In order to counteract these developments, rents should only increase by a maximum of 2% in 2026 and in 2027.
Thanks to the new regulations, tenants are expected to save a total of 138 million euros in 2025. The rental price brake applies exclusively to the regulated rental area, including categorical rents (before 1949), guideline rents with value protection and guideline rents with consumer price index clause. However, it does not apply to rents in the free area, whereby cooperative and municipal apartments are excluded.

In addition to the current regulations, the government is planning further measures, such as increasing the minimum limitation of rental contracts to at least five years. Vice -Chancellor Babler emphasized the complexity of the legal basis, especially for the unregulated area, and made it clear that there are currently no quick solutions.
The rental price brake was first introduced in 2015 to slow down the increase in living space rents in metropolitan areas. In the case of new rentals, the rent may be a maximum of 10% above the local comparative rent, which is determined by rent index. However, it should be noted that some new buildings that were rented for the first time after October 1, 2014 are excluded from this regulation. At the same time, there are specific exceptions and regional differences that influence the applicability of the rental price brake.
The tenant association in Austria (MVÖ) offers a free review of rental contracts from June 10th to 13th, 2025 to help the tenants recognize possible injustices. Dr. Stefanie Hubig, Federal Minister of Justice and Consumer Protection, underlined the importance of the rental price brake and spoke out for her extension. She emphasized: "Housing must not become a luxury goods" and sees an important step in the extension to protect the tenants.
