S8-out: Court stops controversial expressway from environmental protection!

In a pioneering decision, the Federal Administrative Court (BVWG) finally rejected the approval for the controversial Marchfeld Schnellstraße (S8). As Volksblatt , the court sees the planned route as not environmentally friendly, in particular because of the significant risk of the Natura 2000 area Sandboden and Praterrasse. The rejection of the project was motivated primarily by the protection of the endangered bird Triel, whose breeding grounds would have been irreparably damaged by the construction work.

According to the decision of the BVWG, the defects in the authorities' procedure and the disregard for nature conservation and species protection law provisions are serious. The Ministry of Environment and Transport must now check alternatives to the S8, such as Die Presse . This includes a re -evaluation of possible route tours that could minimize the environmental impact. In addition, the court emphasizes that public interests require stronger consideration of environmental protection impacts.

Environment Minister Leonore Gewessler (Greens) was pleased with the judgment and emphasized that this was a signal for revising environmentally friendly solutions. "The S8 would have been a fossil of the past," says Helga Krismmer, State Spokeswoman for the Greens in Lower Austria. On the other hand, critics like the FPÖ politician Udo Landbauer find the decision as a "heavy slap in the face" for the traffic-plagued citizens of Lower Austria. While the discussion about the S8 continues, the BVWG has set a clear accent for nature conservation and questioned the procedure of the approval authorities.
