Political interference? FPÖ warns of the abuse of justice in Austria!

Deutschland - fpö justice spokesman NABG. Mag. Harald Stefan sharply criticized the current situation in the judiciary on April 17, 2025. In his statement, he highlights the occupations at the Administrative Court and other maximum courts, which he sees as a form of the judiciary's party policy abuse. He finds particularly worrying that the SPÖ boss and Vice Chancellor can participate in Absoles when ordering a supreme judge. Stefan sees this as a violation of the fundamental principle of the separation of powers, which in accordance with Article 20 paragraph 2 of the Basic Law provides for a clear separation of state forces.

The separation of powers, which according to the Basic Law forms the basis for the distribution of state power to legislative, executive and judiciary, plays a central role in the rule of law. This division is crucial for the control and limitation of power to protect the fundamental rights of citizens from abuse. Stefan emphasizes that speeches are still politically staffed during a depoliticization of the judiciary.

criticism of the state prosecutor's office

Particularly critical of Stefan comments on the planned introduction of the federal prosecutor. He fears that this could lead to a politically used peak of instructions without political responsibility. He calls this a democratic step backwards that undermine parliamentary control. The jurisprudence plays a vital role by monitoring compliance with the laws and protecting civil rights. However, considerations of the state prosecutor's office give concerns in this context.

Stefan emphasizes that the government has expressly agreed to “strengthen independence from administrative courts”, an obligation, which in his opinion is not implemented. The existing political parties - black, red and pink - continue to share the top of the judiciary and thus neglect the necessary independence of the judiciary, which is essential for a functioning democracy.

The role of judiciary in democracy

The monitoring of compliance with laws and ensuring justice are at the center of the judicial area of responsibility. An independent judiciary that is protected from political influence guarantees fair and impartial judgments. Their absence could not only endanger confidence in the judicial system, but also undermine civil rights and the rule of law. Such a development would be fatal for democracy, which is based on the principles of the separation of powers, the rule of law and the preservation of freedom rights.

In view of this situation, it becomes clear how important the independence of the judiciary is. It not only enables the necessary control over state institutions, but also protects against abuse of power. Mechanisms to ensure this independence such as the lifelong appointment of judges are crucial to ensure a balance within the state of the state that is based on historical ideas of philosophers such as Montesquieu.

Overall, the statements of Stefan and the legal context make it clear that a critical examination of the judicial reform and the political influence on the judiciary is urgently necessary to preserve the trust of citizens in the rule of law and democracy.
