Tax crisis for gastronomy: FPÖ warns of tips for tips!
In the domestic gastronomy and tourism industry there is an alarm mood. The latest decision by the Federal Finance Court (BFG) ensures uncertainty and could endanger many companies. According to a judgment from January 2025, tips are only tax -free up to a maximum of 25 percent of gross wages. Drinking funds that exceed this amount are no longer considered to be “customary” and are retrospectively subject to social security contributions, which could lead to high additional payments. Thomas Reisenzahn, Managing Director of the Prodinger Tourism Consulting, warns of a dangerous climate of legal uncertainty, while numerous companies could face the ruin.
Against this background, the FPÖ is concerned about the reforms for the tax treatment of drinking money. FPÖ tourism spokesman Christoph Steiner criticizes the requirements of the federal government and the credibility of the President of the WKO and ÖVP economic association, Mahrer. According to Steiner, there are no clear measures for tax exemption for drinking money in the government program, which only speaks of an "evaluation". In the current discussion, Steiner criticizes the late demand for tax exemption, which he refers to as "eye emissions".claim for tax exemption
The FPÖ calls for a fundamental tax and tax exemption for drinking money. This step would be particularly important because drinking money in gastronomy and tourism pose significant additional additional earnings for the employees. In a sector that has to deal with low salaries and an acute lack of staff, taxation of drinking money could also put a strain on the affected companies. The tax -free upper limit for tips is currently between 40 and 50 euros.
The new interpretation of the legal regulations means a problematic situation, especially for seasonal companies and part-time workers, whose tips are typically higher. Experts therefore call for a modern, practical solution to create legal certainty for all companies. A uniform appeal goes to the federal government to act quickly in order to evaluate the regulations for drinking money and to find fair solutions that also take into account the shortage of skilled workers in tourism.
Overall, it is clear that the current situation requires an urgent need for action. Industry representatives and the FPÖ are calling for clearer and binding measures to secure the future of gastronomy and tourism industry in Austria. These developments should be followed carefully in order to be able to react to it in good time. The entire topic is not only a legal challenge, but also a social if you consider the livelihood of many employees and keep an eye on the economic framework.
