In a historical case that was negotiated on March 16, 1998 in front of the High Court Malaya in Kuala Lumpur, it was about a legal dispute between the plaintiff Low Kon Fatt and the defendant Port Klang Golf Resort (m) SDN BHD. The plaintiff had paid for membership in the Golf Resort RM32,000 and claimed that it was prompted by a misleading presentation in a prospectus with promised lake port systems for signing the contract. He applied for to withdraw from the contract and to receive the sum back. The defendant rejected the allegations and referred to an exclusion clause in the prospectus.

The court found that statements that are presented in a prospectus as a fact can have contractual strength if they motivate the contractual partner to sign the contract. It decided that the non -fulfillment of the promised lake port systems is a basic breach of contract. The plaintiff was thus supported in his request and received the reimbursement of RM32,000, but without interest, since he had used the golf courses.

The reporting on this case shows how decisive the correctness of information can be in advertising documents and which right consumers have in the event of breaches of contract.
