According to the Federal Constitutional Court, an increase in the damage amount from 2.5 million euros was determined to over 4.7 million euros, which not only significantly increases the risk of escape, but also influences the view of the judiciary on its social ties to Germany. The complainant had adhered to all requirements in the past, but the new situation is considered considerably and degrading for the judicial adversity resolutions, as the detailed documentation shows by the court.

The judges concerned emphasized that the serious allegations and the associated amount of damage represent a significant change in comparison to the previous assessment. The importance of the ongoing investigations is underlined by the possibility of an escape incentive, since contacts were determined in his home countries, which could make it easier to immersion. While the Syrian tug gang was broken down by the police cooperation, the complainant's case remains a significant challenge for the judiciary to ensure the balance between personal freedom and the need for effective law enforcement, the Federal Constitutional Court .
