The man who struggles with a reduction in intelligence and a serious speech error is charged with dangerous bodily harm, severe theft and violation of the Animal Welfare Act. On October 6, 2022, he is said to have stolen 25 ornamental birds from an allotment garden parcel, including budgies and nymphic, with a total value of 2,500 euros. Just a few days later, 16 of the stolen birds were discovered in his apartment - three dead, the others disappeared.

The situation continued to escalate when Werner B. threatened his own brother, Heiner B., with a spade and previously attacked it with beer bottles. These violent outbreaks took place when Heiner tried to confront his brother why he had not moved out of the common house that had become a chaos after the death of her parents. Heiner described that Werner was often aggressive and ancient, and that he had previously stolen birds. "He always denies everything," says Heiner.

Psychological problems and love for animals

The defense argued that Werner B. had found the birds in a sack and had no criminal intentions. But reality is dark: it cannot take care of the animals appropriately and lives in a terrible environment. His brother and the supervisor expressed concern about the catastrophic conditions that surround Werner. At the negotiation, a psychiatrist found that Werner knows that theft and violence are wrong, but is unable to control his behavior at emotional moments. "When he feels pushed into the narrow, he freaks out," said the expert.

The court finally decided on acquittal, but made it clear that Werner B. was not allowed to attack animals or humans again. He has now switched to a smaller apartment where he receives the necessary support. A case that challenges the limits of law and understanding and raises the question of how to deal with people in such situations.
